Terms and Conditions

1. Acceptance of Terms

By accessing or using the Flare mobile application ("App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you may not use the App.

These Terms constitute a legally binding agreement between you and Flare ("we," "us," or "our"). By creating an account or using any feature of the App, you acknowledge that you have read, understood, and agree to be bound by these Terms.

2. Eligibility

You must be at least 13 years of age to use Flare. By using the App, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

3. Geographic Availability

Flare is available worldwide. We reserve the right to restrict access from specific locations at our sole discretion.

4. Account Registration and Security

You must provide accurate, current, and complete information during registration. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access or security breach

We reserve the right to suspend or terminate accounts that provide false information or violate these Terms.

5. Content Ownership and License

5.1 Flare's Ownership

By posting, uploading, or submitting any content to Flare (including but not limited to flares, photos, comments, messages, or other materials), you grant Flare a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media.

All content submitted to Flare becomes the property of Flare. This license continues even if you stop using the App or delete your account.

Content ownership does not override applicable privacy rights or obligations relating to personal information.

5.2 Your Responsibilities

You represent and warrant that you own or have the necessary rights to any content you submit and that such content does not violate any third-party rights or applicable laws.

6. Prohibited Conduct

You agree not to:

• Harass, threaten, intimidate, or harm other users
• Post spam, advertisements, or unsolicited promotional content
• Impersonate any person or entity or misrepresent your affiliation
• Post illegal, obscene, defamatory, or offensive content
• Violate any applicable local, state, national, or international law
• Interfere with or disrupt the App or servers or networks connected to the App
• Use automated systems (bots, scrapers) to access the App
• Collect or harvest personal information of other users without consent
• Post content that infringes on intellectual property rights of others
• Engage in any conduct that restricts or inhibits anyone's use of the App
• Share or distribute sexually explicit content involving minors
• Promote violence, self-harm, or dangerous activities

7. Content Moderation and Reporting

7.1 Reporting System

Flare provides a reporting system for users to report content or behavior that violates these Terms. All reports will be reviewed by our team.

7.2 Content Removal

We reserve the right, but not the obligation, to monitor, review, and remove any content that violates these Terms or is otherwise objectionable, at our sole discretion.

7.3 Account Suspension and Termination

Accounts that are frequently reported for content violations will be investigated. We reserve the right to suspend or terminate any account at any time, for any reason, at our sole discretion, including but not limited to:

• Violation of these Terms
• Multiple reports of prohibited conduct
• Fraudulent or illegal activity
• Behavior that harms other users or the Flare community

Account termination decisions are made solely at the discretion of the Flare team and are final.

8. Data Retention

Flares stop appearing as active events after they expire. Expiration does not automatically delete the event, its comments, or its media. Please refer to our Privacy Policy for information about data retention and account-deletion requests.

9. Third-Party Services

Flare uses third-party services including Firebase, Apple, and Google. By using Flare, you acknowledge and agree that you are also subject to the terms and conditions and privacy policies of these third-party service providers:

We are not responsible for the practices or policies of these third-party services.

10. Disclaimers and Limitation of Liability

10.1 "As Is" Service

FLARE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

10.2 No Warranty

We do not warrant that:

• The App will be uninterrupted, secure, or error-free
• The results obtained from using the App will be accurate or reliable
• Any errors in the App will be corrected
• Location data will be accurate or reliable
• The App will meet your requirements

10.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FLARE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to or use of or inability to access or use the App
• Any conduct or content of any third party on the App
• Any content obtained from the App
• Unauthorized access, use, or alteration of your transmissions or content

IN NO EVENT SHALL FLARE'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED ONE HUNDRED DOLLARS ($100) OR THE AMOUNT YOU PAID US IN THE PAST TWELVE MONTHS, WHICHEVER IS GREATER.

10.4 Location Services

Flare uses location services to provide core functionality. We make no guarantees about the accuracy of location data. You acknowledge that location-based features may not always be accurate and should not be relied upon for critical decisions.

11. Indemnification

You agree to indemnify, defend, and hold harmless Flare, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any rights of another party
• Your content or conduct on the App
• Any misuse of the App or services

Flare is completely indemnified and holds no responsibility for user actions, content, or any consequences arising from the use of the App.

12. Modifications to the Service and Terms

12.1 Service Changes

We reserve the right at any time to:

• Modify, suspend, or discontinue the App or any features
• Change pricing or introduce fees for services
• Impose limits on certain features or restrict access
• Update or change the App without prior notice

We have full control and discretion over all aspects of the service.

12.2 Terms Changes

We may revise these Terms at any time at our sole discretion. Changes will be effective immediately upon posting to the App or Documentation. Your continued use of the App after changes constitutes acceptance of the modified Terms.

13. Dispute Resolution and Governing Law

13.1 Informal Resolution

Before filing any formal dispute, you agree to first contact us at support@shootaflare.com and attempt to resolve the matter informally within 30 days.

13.2 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to conflict of law principles.

13.3 Waiver of Class Actions

To the fullest extent permitted by applicable law, you agree to resolve any disputes with Flare on an individual basis and waive your right to participate in class actions or class-wide arbitration.

13.4 Content Moderation

Decisions regarding content moderation, account suspension, and feature availability are made at Flare's sole discretion. While these decisions are final, you may contact us to appeal or request further review.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Flare regarding the use of the App and supersede any prior agreements.

16. No Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. Any waiver of any provision of these Terms will be effective only if in writing and signed by Flare.

17. Assignment

You may not assign or transfer these Terms or your rights under these Terms without our prior written consent. We may assign these Terms without restriction.

18. Survival

The following sections shall survive termination of these Terms: Content Ownership and License, Disclaimers and Limitation of Liability, Indemnification, Dispute Resolution and Governing Law, and any other provisions that by their nature should survive.

20. Acknowledgment

By using Flare, you acknowledge that you have read these Terms and Conditions, understand them, and agree to be bound by them. If you do not agree to these Terms, you must immediately stop using the App and delete your account.
